TEXAS INJUSTICE: BOBBY YATES – WRONGFUL CONVICTION IN THE MAKINGS

(Lamar County Texas, City of Paris), TX – 3/20/2010 --  Residing in the deeply troubled  and [color-aroused] town of Paris, Texas lives a Black gentleman who has suffered a lower body amputation including a penectomy.  Mr. Bobby Yates, age 51, lost his lower limbs and lower body as a result of a hunting accident 20 years ago.

On Wed. March 23, 2011, Bobby Yates is facing jury selection for the sexual assault of a 16 year old white girl.  On March 18, 2008 Yates was attacked in his home and called 911. The 911 tape clearly plays his cries for assistance but, the police report says otherwise. Bobby Yates is yet another wrongful conviction in the makings.

A photo of Yates was taken for the grand jury indictment and he appears to be standing in that photograph. His height is not included with the grand jury information.  Mr. Yates is not able to stand as he has no legs.

Bobby Yates is scheduled for jury selection on Wed. March 23, 2011. His court appointed attorney has filed a motion to withdraw as attorney of record. That motion has not been heard to date. Bobby would be pleased with the attorney's removal as he has not prepared for his case properly, refused to acquire expert witness testimony and has tried to coerce Yates into a plea deal.  Masses are needed in the courthouse on Wednesday March 23, 2011 where jury selection is scheduled in the case of The State Of Texas v. Boby Yates.

This case is bizarre. Two white men supposedly witness a Black man, in a wheel chair, engaging in a sex act. The white men could be charged under the Texas code for witnessing the alleged sex act.

Obviously, these three white people could be charged with numerous crimes. But, as is so often the case:

A wise old judge
sat in court.
The case was long,
his judgment short.
"Why change the way it's always been?
Convict the man of darker skin."


That comes from Inner City Mother Goose, which is a children and adults book from the late sixties or very early seventies.

In many parts of the United States, nothing has changed since then.

To be convicted of committing a sex act with respect to this girls, the State has to demonstrate that there was "intent". They have to demonstrate that Bobby Yates, while sitting in a wheel chair, surrounded by three strangers, was somehow able to act on his intent without the objection or intervention of these two white guys who arrived at the apartment with the white girl.

How in the hell, except before an all-white Paris, Texas jury, can the state ever prove that Yates was able to have intent and to effectuate that intent while sitting in a wheel chair, when two male acquaintances of the white girl were present?

In fact, anything and everything that happened must logically be assumed to be the result of the intent of these three intruders--not of Bobby Yates.

When a man, in a wheel chair, in his own home, is confronted in the wee hours of the morning by three people, capable of letting themselves into the apartment with or without Yates' permission, it becomes entirely impossible to determine Yates' intention with respect to anything that happened, because Yates' was utterly incapable of expressing any intent, while effectively being held hostage in his own home, wheelchair bound.

It's quite obvious that the police went to the residence and, given a choice between arresting the white intruders who clearly could have been charged with a number of crimes, or arresting the Black man in his own home, the police chose to arrest the Black man in his own home.

It is unlikely that there can be any solution to this in a court of law in Paris, Texas, because law enforcement employees there are notoriously color-aroused to persecute Black people.

Only in the court of public opinion can the absurdity of this situation bring shame to bear upon officials of Paris, Texas, and thereby free Bobby Yates from the threat of imprisonment and registration as a sex offender, which would make him ineligible for public housing, even though he is an old man in a wheel chair.

call the white house and speak with Kathy... i just did.... post info on your facebook page and contact Gary Young, the prosecutor... and leave a message....they probably won't answer ... let them know you're advocating for justice for Mr. Bobby Yates and organizing grassroots campaigns until there is justice for this young MAN.
